Significant changes have been made to employment law regarding casual employees. As of Monday, September 27th (with the exception of small businesses) you need to have assessed whether existing casual employees are eligible to become permanent employees.

As an employer, you are required to:

• make a written offer to convert casual employees with more than 12 months service to permanent employment (within 21 days after the assessment), or
• write to employees explaining why they won’t be made an offer (within 21 days of making the assessment but by no later than 27 September 2021).

Employers are now required to give every new casual employee a Casual Employment Information Statement (known as the CEIS) before, or as soon as possible after, they start their new job.

Small business employers need to give their existing casual employees a copy of the CEIS as soon as possible after 27 March 2021. Other employers have to give their existing casual employees a copy of the CEIS as soon as possible after 27 September 2021.
